President’s Plan Limits Flexible Spending Accounts

The overhaul of the U.S. health care system recently signed by President Obama sets severe new limits on the use of flexible spending accounts, including a $2,500 cap on FSA contributions and restrictions on using FSAs to purchase over-the-counter medications.

Although much of the president’s plan would phase in over time, many of these restrictions are set to take place next year, causing chaos to benefits-plan administrators and human resources departments throughout America.

Radical Changes

Jody Dietel, chief compliance officer at Wage Works, a San Mateo, California company specializing in health care plan administration, notes the “radical changes” to FSAs. She says the reform package passed by Congress on March 21 caps FSAs at $2,500.

“Currently there are no limits for FSAs, and employers often set a limit generally at $5,000,” said Dietel. “In fact, the state of California has a $5,000 max for their employees, the federal government has a max for its workers at $5,000 as well, so cutting that by $2,500 affects the government's own workforce.”

The health care overhaul also effectively eliminates the use of FSAs for over-the-counter drug purchases.

“I do not think that is good health care policy, as study after study shows over-the-counter drug purchases bend the cost curve: You do not have to go to the doctor and secure a prescription,” Dietel said.

Personal Tax Hike

Eliminating FSAs is likely to net the government $68 billion in additional revenue, according to Dietel. She says the government is looking at eliminating flexible spending accounts partly as a means of increasing its revenue stream.

Joseph Antos, a policy expert at the American Enterprise Institute in Washington, DC, believes FSAs are a good deal for Americans.

“Flexible spending accounts are good precisely because they take advantage of the tax system, a system which is fundamentally flawed,” he said. “They give people the opportunity to accrue additional tax benefits in securing health care. The question of what medical services actually cost is confused in our present system, but with FSAs we have further padding around the nerve endings of whether or not to buy something, and [in determining] if that something is of good value.”

Excise Tax Hike

Dietel notes the health care reform legislation also creates a 40 percent excise tax on flexible spending accounts that employers will have to pay if they offer an FSA to their employees.

“The excise tax is very problematic,” she said. “If I am an employer, I am not going to pay a 40 percent excise tax to have flexible spending account plan.”

This is a complete outrage and congress should not pass it. Of course the main stream media never pickss up on it. My family struggles month after month. We rely strongly on our flexible spending account to pay (out of pocket) expenses for our childrens' medical procedures that the insurance companies will not cover. This $2500 cap will be a great financial set back to us. This is completely unjust and disgusting.

Speaking as someone who has been employed in the FSA service industry for over 3 years now, I think it is safe to say that this "reform" is only beneficial to government entities and those that use them exclusively for health care. It is true that we are looking at a restriction of FSA Healthcare to $2500 by 2013 and that OTC will be restricted starting 1/1/2011. This action has created a chaotic reaction in my industry and, coupled with the recent ARRA releases for COBRA continuation, is showing our entire healthcare system in the confused bureaucracy of our government to be fundamentally flawed. Yes, Charleysfarm, it will now be 26 years old and still considered a dependent...bully for us, when will we grow up? And Oana, if you actually plan your year accordingly and use some of the many resources available to do so, an FSA account can be used to great effect. If you have a problem with your administrator, get another one, there are many. I speak from experience in telling you I have had exhaustive training, know exactly what I am talking about and care for my clients and their participants.

For everyone reading this--Remember, there is an election in November. Every house member is up for re-election and a third of the Senate. Get to the polls and vote. Look up the senators from your states to see if they are up for re-election. And in November, vote the democrats out of the house and senate. Without the democrats, Obama can't get what he wants. Remind your friends that November is just around the corner. Get out there and vote. And, get involved with your candidates. Help them fund raise, make phone calls ext.

If the Federal Government (Obama) would quit the stimulus packages, i.e. washing machine's, refrigerator's, automobile's, etc. (you get the picture) they wouldn't need to mess with FSA accounts. I guess the thought behind this is that people on walfare (Obama supporters) don't need FSA's because the government pays their medical but they do need the refrigerators, cars, etc. I get so upset with all the people who didn't vote in the last election because they thought that McCain and Obama were both bad. Well, this is what they get.

When will the mainstream media ever start to report exactly how this president is saddling the middle class with every cost imaginable! With no jobs left, there will be nobody to pay taxes anymore! How can we stop this from ruining America when it just gets worse every day? This "Healthcare reform" is just another way to give more of our paychecks to someone who doesn't want to work or pay their own bills!

This is a tax hike for all who plan ahead and pay attention to medical expenses that do not exheed the % to qualify to claim on your income taxes as medical expenses. Healthcare reform will provide no benefits to me and will only cost me more in the end.

This so called health care plan is doing just what everyone who works for a living knew it would. it is taking away what few bebefits we do have and making the middle class pay for it.Taxes on corporations and the welthy will be passed down to working people in one form or another.This is why the majority of americans ( working people) do not want it.This health care plan is already increasing the medical cost to the people.

Hey "charleysfarm" comments like yours are idiotic <Those that don't want socialism should stop driving on our roads and expecting the fire dept to protect them. All service provided by the government but no one calls these socialism. Also, stop sending your kids to public schools. Another form of "socialism.”> These are basic things the government is obligated to supply and regulate. Americans are confusing what is a "right" and what is a privilege of living in a free society. Health care is not a "right.” Yes, it should be regulated, but that is as far as it goes.

I have found that my FSA accounts over the past few years has help me tremendously when I've had copays - without the FSA it would of been a real struggle to pay some of the copays I've had.

What is not said here is how much costs to manage this Flex Plan. Money that can be allocated to other more beneficial programs. Another missing piece is: what is the actual funds that are not utilized by participants due to a various reasons and by law it is not reimbursable or rolled over to the next benefit year so people can really benefit. The article mentions that current plan does not have a cap, and that employers set the maximums, so how come was not possible to roll over the unused amounts to the next benefit year? For example people, like me, that need major dental work in addition to the regular medical expenses can afford to save and have it done in a shorter period of time then waiting year after year to do a little bit of the time. It is so sad to see the hire ups agenda when is comes to their loss and try to tell people other wise. The new plan is helping people at least to have less calculated losses and hopefully cut out the cancer in this type of organizations. There is on mention to lack of training of the customer services being paid to answer customer questions and are completely incapable on performing their duties (I talking from experience, a very disappointing one). More proactive action would be appreciated more than blaming the new Health Care la

As a doctor I can tell you that I see several patients a day who are on governmental sponsored plans. They come in and complain of pain and ask for prescriptions for OTC medicines so that they are covered by the goverment aid. So a $5 bottle of OTC drug costs the government the doctor visit and the $5 OTC medicine. The best thing to come out of the FSA accounts were that less people came in to get prescriptions for allergy and sinus medications -- now I expect to see them back in my office.

Socialism is a centrally planned economy controlled by the government. With government control of schools, health care, banks... yes I think we are on the verge of a socialist society. The new laws for FSAs is purely to make more money for the government. There is no benefit for the individual by cutting these benefits. To assume that FSA's won't be necessary because health care is going to be more affordable, is naive. In order for the government to provide a service for the people it must take from the people. The government does not have a source of income other than to tax the people. So to think that we are going to get "free" health care or reduced cost health care is not rational. These regulations on FSA's will do nothing but benefit the government not you as an individual. The government should be supporting more self reliance in the public not more dependence.

I think my allergy, cold and headache medication, 81mg Asprin for blood thinner, yeast infection meds, antibotic creams, bandaids... etc, etc, are ALL part of my medical care. Why should it be treated any differently whether I get it from my doctor or my pharmacist? And what about all my co-pays? That's medical care too! I feel like this new plan is a lose-lose scenario for me and everyone else like me. And how much more are my taxes going to go up to pay for this new bureaucracy?? Since last year my family's taxes have already jumped by $800. per month. If the "rich" middle-class have to shoulder this expense, pretty soon we won't have a middle class. We can't afford any more taxes without giving up the home we've owned for 10 years. Sure doesn't feel American to me. I've worked my tushie off for 35 years as has my husband. We earned our home with the sweat of labor equal to 70 year's worth. Before we drive out the middle class, we need to audit all government systems and see where our money is REALLY going!!!! Do I know you Linda?

I'm very angry and upset. I've used FSA accounts for many years. I'm a paraplegic. I work but I'm not wealthy. This change will be costly for me.

There are always trade offs. We will soon not have to pay any copays for annual exams and other things like GYN exams. Also children will be covered for a longer time...I forget if it is age 26 or higher. Those that don't want socialism should stop driving on our roads and expecting the fire dept to protect them. All service provided by the government but no one calls these socialism. Also stop sending your kids to public schools. Another form of "socialism". I don't think the changes are perfect but they can be adjusted down the line. I would rather not have to save my money in an FSA where I have to either use it or lose it. If I can get my benefits in other ways that would make my life easier.

I have been using Flexible Spending accounts for 5 years now.It is how I am able to afford the medicition that I have to take EVERY DAY FOR THE REST OF MY LIFE.Course, with health care "reform", I will no longer be able to afford my medication, if it is deceided that I can even take it anymore.Without the insurance I have, I would have to pay 1000.00 for a 3 month supply.Thank God for my health insurance, because the copay is 90.00.Still a lot.To away with my Flexible Spending Account, getting my meds will be harder.Not allowing the purchase of OTC drugs, just another way for the socialist government to run our lives and further OVER BURDEN an already stretched to the limit medical system. But hey, what do the politicans care. They exempted themselves from having to use it anyway.

and lots of things like allergy meds are moving towards OTC... so now that is all MY expense, not shared by my medical plan AND having a small tax subsidy.... That STINKS

There are always trade-offs that come with change. Maybe we wouldn't need FSA's so much if healthcare was easily accessible and affordable for all.
