Today, Certificate-of-need, or CON laws, in 35 states cover a host of health care services and facility expansions. These laws were intended to make health care more accessible. Instead, they have hindered growth and stifled competition in the medical marketplace.
As cronyism and anticompetitive practices—which are inherent to CON laws—have ravaged markets in all industries, the health care market is no exception. The negative effects of government overreach are seen in high costs and outdated hospitals and technologies. Unleashing the free market would level the playing field within the health care market while providing more choices to patients.
COVID-19 has exposed how outmoded and unneeded regulation, putting lives at risk and kept delivery of health care at the whims of politicians, not physicians.
