The Heartland Institute submitted these comments in response to EPA’s ANPR entitled Regulating Greenhouse Gas Emissions Under the Clean Air Act. Attorney Maureen Martin discusses why regulation of greenhouse gases through the ANPR and its supporting documentation would be unconstitutional and unlawful.

Not only was there an error in the official notice for the ANPR, Martin notes, but regulation of greenhouse gases under the Clean Air Act by EPA would exceed the agency's statutory authority under that act. She concludes "Against a small, weak, and immature scientific background [with respect to the impact of human carbon dioxide emissions on global warming], regulation is unwarranted, irrational, arbitrary and capricious."
