Decision overturning the U.S. Fish and Wildlife Services decision to list the lesser prairie chicken as threatened under the Endangered Species Act

In a September 1, 2015 decision, Senior U.S. District Judge Robert Junell for the Western District of Texas vacated the FWS Final Rule that listed the lesser prairie chicken as a threatened species. Junell concluded FWS violated their own rules in listing the bird as threatened and agreeed with the states under the ESA, FWS failed to fully “tak[e] into account those efforts, if any, being made by any State … to protect such species.”
